TERMS OF USE

TeleGuard has a clear corporate policy: strictest observance of data protection and uncompromising protection of user privacy. TeleGuard is Swisscows AG‘s data-secure messenger. Data protection has been the focus of Swisscows AG since it was founded. It is our ultimate goal to only save the information that is absolutely necessary for the shortest possible time ("Privacy by Design"). In addition to using the latest encryption methods, we take all necessary technical and organizational measures to prevent unauthorized access to and misuse of data.

1. General
The TeleGuard app (hereinafter «TeleGuard ») was developed to leave as little data as possible on a central server. All servers are located in the data centers in Switzerland. The specification of personal data, such as telephone number, email address, etc. is therefore not necessary to use the app.  A participant can only be identified by means of an 9-digit ID or a QR code. Groups are only managed on the end devices involved.

TeleGuard is used without providing personal data.

2. Registration
No data such as telephone number, email or other personal data is used for registration. No registration is necessary to use TeleGuard.

3. Address book
Teleguard does not take over any data from the device. No address book, contacts or similar stored in the device.

4. Cancellation
No cancellation is required for the use or termination of the use of TeleGuard. Once the app is deleted, all data and the account will also be deleted. Since no data is stored on the server, the account or data from the account cannot be recovered.

5. Age
In order to use TeleGuard, the user must be at least 13 years old (or, if the relevant age is higher, as old as required in the user's country or territory). In addition to the requirement under applicable law that the minimum age required to use TeleGuard be met, the following applies: If the minimum age is not reached to be eligible to agree to our terms of use, a parent or guardian must agree to our terms of use on behalf of the user.

6. Purpose of data processing
TeleGuard processes data to enable the transmission of short messages and media to other participants. The processed data is processed exclusively by TeleGuard on its own server infrastructure in Switzerland and is not passed on to third parties.

7. Scope and duration of data processing
7.1 Inventory data
As part of the use of TeleGuard, the following inventory data is collected or stored:

    • TeleGuard ID
    • Operating system and version of the Swisscows app
    • Date (without time) of the last login

The following information is optional and can also be provided by the user on request to make it easier to identify:

    • Nickname

When exchanging messages, only the following information is passed on to other participants:

    • TeleGuard ID
    • QR code
    • Nickname

A disclosure to third parties does not occur.
All information is only saved until it is deleted by the user. Once the information is deleted, it cannot be recovered.

7.2 Message content
TeleGuard encrypts all messages, including control messages, with a highly secure end-to-end encryption method.

The header information of a message (sender, recipient, etc.) is additionally encrypted for transmission to the server or from the server to the recipient in order to make it impossible for third parties to eavesdrop on this information (e.g. in open wireless LANs).
As the operator of TeleGuard, Swisscows AG has no way of decrypting messages from users on the server, since it has no knowledge of the private keys.

Encrypted messages are completely deleted from the servers as soon as they have been successfully delivered. If the messages and media were not collected or not completely collected, they will be automatically and irretrievably deleted from the server after two weeks. Media (pictures, videos, files, etc.) are stored for up to 1 month as soon as the user takes them into the cache of their own device, and if the cache is emptied, they cannot be retrieved again.

7.3 Contact details
At no time will the user's contact data be saved.

7.4 Crash reports
In order to be able to improve the stability and reliability of the app, TeleGuard relies on anonymized crash reports.

Crash reports do not contain any personal data. They consist of a stack trace, some information about the device (model, operating system version, but no serial number, etc.), the app version, the time stamp of the start and the crash, and the list of software libraries loaded in memory. They do not contain any processor register contents or log messages.

8. Data processed by third parties
TeleGuard basically does not pass on any data to third parties, is completely free of advertising and does not use any analysis software to monitor user behavior.

10. Change of the terms of use
We reserve the right to adapt these terms of use from time to time in order to meet changed legal requirements or to implement new functionalities in the user conditions. The current user conditions can always be found on our website: https://teleguard.com.
